Welcome to STASISM! By accessing or using our home-based digital exercise software (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, you may not use the Service.
1. Acceptance of Terms
By using the Service, you affirm that you are at least 18 years of age or have the consent of a parent or legal guardian to use the Service. You acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.
2. Description of the Service
The Service provides digital training programs, exercises and exergames. These programs are designed for home use and are not a substitute for professional medical advice, diagnosis, or treatment. The Service is an exercise and wellness product; it is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition.
3. Medical Disclaimer
3.1 Not Medical Advice: The Service is intended for general informational and educational purposes only. It does not provide medical advice, and you should consult with a qualified healthcare provider before beginning any new exercise program.
3.2 Individual Responsibility: You are solely responsible for determining whether the exercises or programs provided are suitable for your individual health conditions. If you experience pain, discomfort, or any adverse effects, stop using the Service immediately and consult a healthcare professional.
4. Assumption of Risk
4.1 User Responsibility: By using the Service, you acknowledge and agree that engaging in physical exercise involves inherent risks, including the risk of injury, discomfort, or exacerbation of existing conditions. You assume full responsibility for any risks associated with your use of the Service.
4.2 Release of Liability: To the fullest extent permitted by law, MoveExo AS and its affiliates, officers, directors, employees, and agents are not liable for any injury, loss, or damages arising from your use of the Service.
5. User Conduct
You agree to use the Service only for its intended purposes and in compliance with all applicable laws. You agree not to:
- Misuse or abuse the Service in any way.
- Share your account with others or allow unauthorized access.
- Attempt to reverse-engineer, copy, or distribute any part of the Service.
6. Intellectual Property
6.1 Ownership of Content: All content, materials, and software provided through the Service are the property of MoveExo AS and are protected by copyright, trademark, and other intellectual property laws. 6.2 Third-Party Games and Content: The Service may allow users to engage in exercises using third-party games or content. Such games and content remain the intellectual property of their respective owners. MoveExo AS does not claim ownership of any third-party intellectual property and provides access solely for integration and use through the Service. Your use of third-party games or content is subject to the terms and conditions of the respective third-party providers.
7. Modifications to the Service and Terms
7.1 Changes to the Service: We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
7.2 Changes to Terms: We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
8. Termination
We may terminate or suspend your access to the Service at our sole discretion, without prior notice, if you violate these Terms or engage in conduct that we deem harmful to the Service or other users.
9. Governing Law and Dispute Resolution
These Terms are governed by Norwegian law. We will try to resolve any disagreement with you directly. If we cannot agree, you can ask Forbrukerrådet, the Norwegian Consumer Council (forbrukerradet.no), to mediate. If mediation does not resolve the dispute, you can take it to the Norwegian courts. This does not take away the protection you have under the mandatory consumer law of the country where you live.
10. Indemnification
You agree to indemnify and hold harmless MoveExo AS and its affiliates from any claims, damages, or expenses arising out of your use of the Service, your breach of these Terms, or your violation of any rights of another party.
